Appeal of Denial of Request for Exception to not construct a portion of Golden Eagle Drive as it abuts proposed Tract 1 of Copper Ridge Subdivision.

Summary: |

The Applicant has submitted a preliminary subdivision plan to plat the Copper Ridge Apartment tract adjacent to Promise Road and abutting Golden Eagle Drive Section Line Highway ROW and proposed Golden Eagle Drive ROW. Golden Eagle Drive is identified as a Collector Street on the City’s Major Street Plan. Rapid City Municipal Code 16.08 and 16.16.040 requires the construction of the portion of Golden Eagle Drive abutting this proposed development and adjacent to the proposed Tract 1. The Applicant has submitted an Exception request to not construct the required Golden Eagle Drive St. street and utility improvements beyond the portion of the street, app. 165 linear feet, needed to access the apartment complex. This exception request is contrary to RCMC and IDCM requirements, and could not be supported by City Staff. The denial of the exception request was subsequently appealed by the Applicant. |

Updated 6.24.15: Mr. Samuelson met with City Staff members on June 24, 2015, to discuss disposition of proposed street improvements, development construction and phasing, platting and future obligation for installation and financing of street improvements. It has be determined that the installation of all of Golden Eagle Drive adjacent to proposed Tract 1 is not needed to serve existing improvements and may be deferred until future phases of development and after further consideration of street alignment, site development, transportation needs and master planning. Identification of funding and development obligations, timing of improvements and related aspects of construction of street and utility improvements may be clarified in a Developer’s Agreement which would be recorded on property. Recorded agreement will provide notice to future purchasers of property and will identify improvements and obligations. |

Revised Recommendation: Approve request for exception to not construct a portion of Golden Eagle Drive contingent on Applicant entering into Developer’s Agreement which allows deferment of construction of Golden Eagle Drive until such time as street improvements are required to serve development or final phase of site development is completed. Executed Developer’s Agreement will identify terms and conditions for subdivision will be recorded on property. |
